The "NBC 10 WEDDING CONTEST" (the "Contest") is sponsored by Media General, Inc., its affiliates or subsidiaries, including but not limited to Media General Operations, Inc., d/b/a WJAR-TV NBC 10 ("WJAR"), Clear Channel, Coast 93.3, The Chapel Grille, Party Dress Express, Place Jewelers, Twigs Florist. (along with WJAR collectively referred to as "Sponsors").
NO PURCHASE NECESSARY. Void where prohibited or restricted by applicable federal or state laws and regulations.
Completion of an Entry Form by entrant constitutes an agreement by that entrant to be bound by these Official Rules and by the decisions of the Sponsors and Contest Judges (as defined below), whose decisions are final. Failure to comply with these Official Rules may result in disqualification. WJAR reserves the right to disqualify any entrant that WJAR believes has violated these Official Rules.
PRELIMINARY INFORMATION
WJAR is giving one (1) prize (consisting generally of an assortment of gift certificates redeemable for wedding-related goods and services, as more fully described below) to an engaged couple ("the Winning Couple") who will be judged and selected by a panel of independent judges.
Anyone considering submitting an entry to participate in this Contest should read all of the information below for eligibility restrictions and limitations, participation requirements and prize description.
Generally, however, please note that all entrants must be willing to, among other things:
* submit a photograph of the entrant couple at turnto10.com or via U.S. mail;
* provide all of the information required in the Official Entry Form;
* if selected as a Finalist Couple (as defined below), be available to be interviewed on camera by WJAR on such dates, and at such locations, as may be chosen by WJAR in its discretion; and
* if selected as a Finalist Couple, submit to a background check;
PLEASE NOTE: This Contest is open only to couples who have been engaged to each other for at least one month prior to entry and who remain engaged to each other throughout the duration of this Contest, who are legal residents of either Rhode Island or Bristol County MA, who are both 21 years of age or older as of September 26, 2011, and who comply with the additional eligibility and other requirements set forth in these Official Rules.
The entry phase of the Contest begins on September 26, 2011 at 12:00 p.m. EST and ends on November 20, 2011 at 11:59 PM EST ("Entry Period"). The winner selection process will take place on December 10, 2011 ("Casting Call") at The Chapel Grille in Cranston, RI, during which time the Winning Couple will be selected. The Winning Couple will be announced on December 12, 2011, or within a reasonable time thereafter.
ELIGIBILITY REQUIREMENTS
Contest is only open to entrants who satisfy all of the following eligibility requirements:
* each couple submitting an Entry Form must consist of two individuals (whether different or same gender), each of whom is at least 21 years of age as of September 26, 2011;
* each couple must have been engaged to be lawfully married to each other for at least one month prior to September 26, 2011 and must remain engaged to each other throughout the Contest (for purposes of these Official Rules the term "lawfully married" shall include couples who intends to unite in a commitment ceremony; "wedding" includes commitment ceremony);
* each individual must be a legal resident of Rhode Island or Bristol County MA;
* each individual must be of good moral character, must have never been convicted of a crime of any nature (other than moving violations of a misdemeanor type that did not involve personal injury, drugs or alcohol), and must have nothing in their background that would be an embarrassment to WJAR, as determined by WJAR in its sole discretion, and if selected as a Finalist, must be willing to undergo a background check and to sign forms authorizing the release of personal and background information to WJAR for that purpose;
* each individual must not be an elected official and must not be currently running for any political office (local, state or federal); and
* each individual must be willing to execute an affidavit attesting to the truth of the facts in the Entry Materials (as defined below) and to that individual’s satisfaction of all eligibility requirements and restrictions in these Official Rules.
Employees of Media General, Inc., WJAR, Clear Channel, Coast 93.3, The Chapel Grille, Party Dress Express, Place Jewelers, Twigs Florist any contributing wedding partner organization(s), and their respective advertising and promotion agencies, their parent, subsidiary and joint venture companies, as well as members of their immediate families (defined as spouse, parents, children and siblings) and households (whether or not related) are not eligible.
ENTRY PERIOD
Entries will be accepted beginning on September 26, 2011 at 12:00 p.m. EST. Regardless of the method of entry, all entries must be received by WJAR by 11:59 PM EST on November 20, 2011.
Entry Materials
All of the following materials must be submitted together and prior to the expiration of the Entry Period in order to complete an entry (collectively referred to as "Entry Materials"): (a) an Official Entry Form, completed with the names, addresses, telephone numbers (main and alternate), dates of birth, and e-mail address(es) of each individual comprising the entrant couple; (b) one photograph of the entrant couple (the "Photo"); and (c) answers (your "Essay Answers") to the following essay questions:
* How long have you been together? When did you meet?
* How did you meet?
* When did you get engaged?
* How did you get engaged?
* Tell us why you should win.
Please limit your Essay Answers to 500 words or less per question but remember, creativity counts! Tell us a story, write us a poem, just plain entertain us!
Submission Requirements
All Entry Materials must satisfy the following additional "Submission Requirements:" Photos and Essay Answers must be original, truthful, unpublished, created solely by the submitting entrants, must not have been submitted in any other competition, must not include any text, content, photos, material or other images that are not originally taken or created by you and must not infringe upon any rights of any third party, including but not limited to copyright, trademark, and rights of privacy and publicity. Do not submit portrait or copyrighted Photos. Photos may not be digitally altered or enhanced, except that images may be cropped and rotated as necessary. No watermarks, signatures, or copyright notices may be added to the Photos.
Transmission of Entry Materials
There are two (2) ways to submit your Entry Materials:
(a) ONLINE: Visit www.turnto10.com, keyword "WEDDING" to complete the Official Entry Form and upload your Photo. Online entries must include an email address. Online submissions are only complete when the confirmation box alerts you that your submission has been successfully uploaded. Please limit uploaded Photos to JPG files only, maximum size 1 MB per photo.
(b) MAIL-IN ENTRY: Print your names, addresses, telephone numbers (main and alternate), dates of birth, and e-mail address(es) on a label, and affix the label to your Photo. Legibly hand-print or type on one or more separate page(s), your Essay Answers. Mail your Photo and Essay Answers in a single package with sufficient pre postage to NBC10 WEDDING CONTEST c/o WJAR NBC10, 23 KENNEY DRIVE, CRANSTON, RHODE ISLAND 02920.
Limit one (1) Entry per couple, regardless of method of entry. Multiple entries received from any couple or e-mail address thereafter will void all such additional entries. Entries that are incomplete, illegible, damaged or corrupted are void and will not be accepted. All Entry Materials, including Photos and Essay Answers, become the property of WJAR and will not be acknowledged or returned.
Warranty/Indemnification by Entrant
By submitting Entry Materials, the entrant warrants that both individuals who comprise the entrant couple have agreed to enter this Contest. By submitting Entry Materials, each entrant further warrants that the Entry Materials are original, were taken or created solely by the entrant, do not violate any copyright laws, and do not plagiarize, libel, defame, disparage, slander or otherwise infringe on or violate the rights of any third parties. Each entrant further certifies that he or she has obtained all necessary and appropriate approvals or consents from all persons and entities participating in or otherwise involved with the creation and production of the Entry Materials.
Each entrant agrees to indemnify and hold harmless Sponsors, their officers, directors, employees and affiliated organizations, and their respective officers, directors and employees, from and against any and all claims, demands, damages, costs, liabilities and causes of action of whatsoever nature that are based upon or arise out of any breach by the entrant of these Official Rules or any warranties and representations required of entrant in this Official Rules.
License
By submitting Entry Materials, you give Sponsors a perpetual, worldwide, non-exclusive license to use, reproduce, broadcast, rebroadcast and exploit such Entry Materials in Contest-related promotions, in any media now or hereafter discovered, except where prohibited.
Limitation of Liability
Sponsors are not responsible for lost, interrupted, or unavailable network, server, or other connections, or for any failed telephone or computer hardware or software, or for any failed, delayed, misdirected, postage-due, illegible, mutilated, corrupted, or garbled transmissions or errors of any kind, whether human, mechanical, or electronic, or for entries that for any reason are not received by WJAR by the deadline stated above.
Privacy
If you enter the Contest through the website at www.turnto10.com, the information that you provide via that Web Site in connection with the Contest may be used by WJAR in accordance with its Privacy Policy, which is found at www.turnto10.com and which may be updated from time to time.
CASTING CALL
Once the Entry Period has ended, the Winning Couple selection process will commence. A "Casting Call" will take place on or about December 10, 2011 beginning at 8:00 AM EST. A panel of independent judges ("Contest Judges") consisting of local members of the business community will conduct a Casting Call at The Chapel Grille, located at 3000 Chapel View Blvd, Cranston, Rhode Island to select the Winning Couple. All couples who enter the Contest must attend the Casting Call in person to remain eligible for consideration in the Contest. Couples will be notified of the Casting Call information by email and regular post office mail no later than December 7, 2011. Couples must check in with WJAR staff at The Chapel Grille at least thirty (30) minutes prior to the 8:00 AM EST start time. WJAR reserves the right to disqualify couples who fail to check-in on time for the Casting Call; any couples who are so disqualified will forfeit their opportunity to participate in the Casting Call and will no longer be eligible for consideration in the Contest.
During the Casting Call, the judges will interview and judge all entrant couples who submitted complete and timely entries and who attend the Casting Call. Entrant couples will be judged based on the following equally weighted criteria as determined from each couple's Entry Materials and Casting Call interview:
* The uniqueness of the couple's history and background (how each couple met, how they became engaged, how long they have been engaged, the relationship of the couple with family and friends, etc.);
* The personality of each entrant, individually and as a couple;
* The couple's ability to articulate their story;
* The couple's interaction with one another; and
* The demonstrated strength of couple's commitment.
Subject to verification of eligibility, the couple who receive the highest score will be determined to be the Winning Couple. In the event of any tie, the tied Finalist Couples will be ranked based on a final interview by the Contest Judges, based on the same criteria identified above. The decisions of the Contest Judges are final and entrants agree to be bound by these decisions. As a condition of continued eligibility, all couples will be required to complete and sign an Affidavit of Eligibility, Waiver of Liability and Publicity Release provided by WJAR, and may be asked to sign other documents, including tax documents.
FINALIST COUPLE OBLIGATIONS
Finalist Couples must be willing to fulfill the following promotional tasks, without additional compensation:
* to be interviewed by telephone;
* to make themselves available to be interviewed by WJAR at times, dates and locations selected by WJAR in its sole discretion;
* to make themselves available for an appearance on WJAR following their wedding ceremony;
* to make themselves exclusively available to WJAR for all other publicity and promotion and not to allow interviews by other media outlets, including television, magazines, newspapers, radio, and internet, unless authorized by WJAR; and
* to be subject to individual background checks to verify eligibility and to rule out any negative background that may reflect adversely on WJAR and to sign any authorizations for the release of information relevant to such checks.
ANNOUNCEMENT OF WINNING COUPLE
On or about December 12, 2011, the Winning Couple will be contacted by telephone to be awarded the grand prize.
DISQUALIFICATION/SELECTION OF ALTERNATES
If the Winner Couple is disqualified, the Finalist Couple or entrant couple, as applicable, with the next highest score from the Contest Judges will be declared the alternate Finalist Couple or Winner Couple, subject to verification of eligibility. If the alternate Finalist Couple or entrant couple is not eligible, the process will be repeated as needed, until either (a) an alternate Finalist Couple or Winner Couple is verified, (b) no eligible entrant couples remain, or (c) there is no longer sufficient time to verify an alternate Finalist Couple or Winner Couple.
WINNING COUPLE OBLIGATIONS
The Winning Couple may be interviewed in person by WJAR. The Winning Couple may, in the sole discretion of WJAR, appear live or on videotape on WJAR during the period of December 12, 2011 through August 31, 2012, but the date is subject to change. However, the Winning Couple acknowledges and agrees that WJAR is not required to promote or broadcast any materials depicting the Winning Couple. WJAR's sole obligation to the Winning Couple is to award the prize described below.
PRIZE
Grand Prize (1): Grand Prize consists of the following gift certificates, with a combined approximate retail value ("ARV") of $9,000:
* Gift certificate redeemable for up to $4,000 at The Chapel Grille. Certificate must be used for a wedding reception and cannot be applied to previously booked events at the venue. Gift certificate to be used between May 1, 2012 and August 31, 2012 – based on venue availability;
* Gift certificate redeemable for up to $2,500 at Place Jewelers, 3228 Post Road, Warwick RI; and
* Gift certificate redeemable for up to $1,000 at Party Dress Express, 657 Quarry St, Fall River MA to be used to purchase a bridal gown;
* Gift certificate redeemable for up to $1,500 in products and services toward your wedding at Twigs Florist, 235 Wilbur Ave, Cranston RI;
Additional prizes may be added in Sponsors' sole discretion, which may increase the ARV of the Grand Prize as a whole. The Winning Couple is not required to accept any of the additional prizes. Any portion of the prize not used by Winning Couple is forfeit and Winning Couple will not be entitled to any alternative compensation or cash difference.
PRIZE RESTRICTIONS
Gift certificates are subject to any additional restrictions or limitations imposed by the relevant issuer. Winning Couple assumes sole responsibility for all costs associated with the prizes not explicitly outlined in these Official Rules, including but not limited to any and all federal, state and local income taxes (if any). Sponsors assume no liability or responsibility in connection with the safety or performance of any prize awarded hereunder nor in connection with any warranty or representation therewith except as provided by manufacturer. No substitution or cash redemption of any prize or any element thereof is permitted except that WJAR may substitute prize or element of equal or greater value if it deems necessary. Only those prizes described above will be provided by Sponsors. Any additional items shall be the sole responsibility of Winning Couple, unless Sponsors, in their sole discretion, provide otherwise. Other restrictions apply.
MISCELLANEOUS
WJAR reserves the right to postpone or terminate the Contest or any component thereof, including without limitation, any part of the selection process, should any non-authorized intervention, network failure, information storage failure, telecommunications failure, malfunction, or other causes beyond its control, corrupt or impair the security, administration, fairness and/or operation of this Contest as determined by WJAR in its sole discretion. In such an event, WJAR will select the Winning Couple from all non-suspect, eligible entries, utilizing the selection process and judging criteria set forth above.
Sponsors are not responsible for telecommunications, network, electronic, technical or computer failures of any kind, for inaccurate transcription of entry information, for errors in any promotional or marketing materials, for errors in these Official Rules, for any human or electronic error, including but not limited to the administration of this Contest, receipt or use of any Prize, or for entries that are stolen, misdirected, garbled, delayed by computer transmissions, lost, late, damaged, or postage due.
Any attempt by an entrant or any other individual to deliberately damage any online service or web site or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws and should such an attempt be made, WJAR reserves the right to seek damages and/or other remedies from any such person to the fullest extent permitted by law. WJAR reserves the right to correct typographical or clerical errors in any Contest-related materials. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, WJAR reserves the right to award only the stated number of prizes in accordance with the selection criteria previously stated herein from among all legitimate, un-awarded, eligible prize claims. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and/or Sponsors in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the state of Rhode Island, without giving effect to any choice of law or conflict of law rules that would cause the application of the laws of any jurisdiction other than the state of Rhode Island. If any controversy or claim arising out of or relating to the Official Rules, or the Contest cannot be otherwise resolved, it shall be resolved in the courts of Providence County, Rhode Island.
PUBLICITY RELEASE
Acceptance of any prize constitutes permission (except where prohibited by law) to use winner’s name, city, state, likeness and/or voice for purposes of advertising, promotion and publicity without additional compensation.
DISCLAIMER/LIMITATION OF LIABILITY
Entrants and participants assume all liability for any injury or damages caused or claimed to be caused by their participation in the Contest, including participation in the Entry Period or Casting Call or any Contest-related promotion activities, as well as the acceptance, use and enjoyment of any Prize. All entrants and participants release Sponsors and their respective advertising and promotion agencies, their parent, subsidiary, affiliate and joint venture companies, as well as their respective officers, directors, and employees, from any such liability. Sponsors and their respective advertising and promotion agencies, their parent, subsidiary, affiliate and joint venture companies, as well as their respective officers, directors, and employees assume no responsibility for any injury or damage to entrant’s or to any other person’s computer relating to or resulting from entering or downloading materials or software. Sponsors and their respective advertising and promotion agencies, their parent, subsidiary, affiliate and joint venture companies, as well as their respective officers, directors, and employees are not responsible for technical, hardware, software, or telephone malfunctions of any kind, lost or unavailable network connections, or failed incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Contest or by any human error which may occur in the processing of the entries in this Contest.
